These Terms and Conditions (“Terms”) govern your access to and use of this website (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Site immediately.
1. Acceptance of Terms
Your access to and use of the Site constitute your agreement to comply with these Terms. If you do not agree to these Terms, you may not use the Site.
2. About Us
This Site is operated by Go Forth International, a registered 501(c)(3) nonprofit organization dedicated to providing medical and health education services to underserved communities (“we,” “us,” or “our”).
3. Use of the Site
You agree to use the Site solely for lawful purposes and in accordance with all applicable laws and regulations. Without limiting the foregoing, you shall not:
- Use the Site in any manner that violates applicable federal, state, or local laws or regulations;
- Interfere with, disrupt, or compromise the security, functionality, performance, or integrity of the Site;
- Attempt to gain unauthorized access to the Site or any related systems, networks, or data;
- Use the Site to transmit, distribute, or facilitate unsolicited advertising, promotional materials, or spam; or
- Engage in any conduct that could disable, overburden, or impair the Site.
4. Intellectual Property
All content, materials, and features available on or through the Site, including without limitation text, graphics, logos, images, audio, video, software, and compilations (collectively, “Content”), are owned by or licensed to Go Forth International and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Except for personal, non-commercial use, you may not copy, reproduce, distribute, modify, publicly display, publicly perform, or create derivative works from the Content without our prior written consent. No rights or licenses are granted to you by implication, estoppel, or otherwise.
5. Donations
5.1 Processing of Donations
Donations made through the Site are processed by Givebutter, a secure third-party fundraising and payment platform. By submitting a donation, you acknowledge and agree that Givebutter may collect, store, process, and transmit your payment information in accordance with its own Terms of Service and Privacy Policy. We do not control and disclaim responsibility for Givebutter’s data-handling or security practices.
5.2 Authorization and Accuracy
By completing a donation, you represent and warrant that:
(a) you are authorized to use the selected payment method;
(b) the information you provide is true, accurate, current, and complete; and
(c) your donation is voluntary and made without expectation of goods or services unless expressly stated (for example, event tickets).
5.3 Non-Refundable Contributions
All donations are non-refundable, except in cases of confirmed processing error or where otherwise required by law. Requests relating to potential processing errors must be submitted within thirty (30) days of the transaction.
5.4 Use of Funds
Unless expressly designated as restricted by the donor and accepted by us in writing, all donations are treated as unrestricted and may be used to support the mission, programs, and operational needs of Go Forth International.
5.5 Third-Party Fees
Givebutter and its associated payment processors (including, without limitation, Stripe and PayPal) may deduct transaction or processing fees from your donation. Go Forth International does not control and does not receive the portion withheld by third-party processors.
6. Third-Party Websites and Platforms; Indemnification
The Site may contain links to, integrate with, or rely upon third-party websites, platforms, and services, including fundraising or payment systems such as Givebutter (collectively, “Third-Party Services”).
Although we manage Go Forth International’s organizational account on Givebutter for donation-processing purposes, Givebutter and its associated processors operate independently and maintain their own terms, conditions, policies, and security and data-handling practices.
We do not control, endorse, monitor, or assume responsibility for:
- the content, accuracy, security, functionality, or availability of any Third-Party Services;
- any acts, omissions, errors, delays, outages, or failures by Givebutter or any other third-party provider;
- any fees, deductions, or processing decisions made by Third-Party Services; or
- any data practices, policies, or terms imposed by Third-Party Services.
Your use of any Third-Party Service, including Givebutter, is solely at your own risk and subject exclusively to that service’s Terms of Service and Privacy Policy.
Indemnification
You agree to indemnify, defend, and hold harmless Go Forth International, its directors, officers, employees, volunteers, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, expenses, and attorneys’ fees arising out of or related to:
(a) your use of any Third-Party Service;
(b) your violation of any terms, policies, or obligations imposed by Third-Party Services; or
(c) your breach of these Terms.
7. Disclaimer of Warranties
The Site and all Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. We make no representations or warranties regarding the accuracy, completeness, reliability, availability, or security of the Site.
Your use of the Site is solely at your own risk.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Go Forth International and its directors, officers, employees, volunteers, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of or inability to use the Site. Nothing in these Terms shall operate to exclude or limit liability where such exclusion or limitation is prohibited by law.
9. Privacy
Your use of the Site is governed by our Privacy Policy, which describes how we collect, use, store, and protect personal information. Your interactions with Third-Party Services, including Givebutter, are subject to the privacy and security practices of those providers. We are not responsible for the policies or actions of Third-Party Services.
10. Changes to These Terms
We reserve the right to amend, modify, or update these Terms at any time. Changes will be posted on this page with a revised effective date.
Your continued use of the Site following any such changes constitutes your acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-law principles.
